Summary of the key points

1. Scope and Application

These Terms and Conditions apply to all business relationships between you and Finsler Customs GmbH, Rebbergstrasse 6, 8240 Thayngen, in particular to vehicles you purchase and/or order via our platform FlexiMoto.ch and to services we provide to you. We reserve the right to amend the Terms at any time; the version in force at the time of booking the service applies.

2. Notice

By using our services, our platform or signing a contract, you agree to these Terms as well as to our Privacy Policy. You also confirm that you are of legal age and entitled to enter into legally binding contracts.

3. Legal Relationship

A contract is concluded as soon as the client electronically initiates an order via the platform FlexiMoto.ch – by completing and submitting the online form (configurator), accepting the Terms, the Privacy Policy and the mandate including power of attorney (e.g. by checkbox) and triggering the order process. A handwritten signature is not required. Finsler Customs GmbH is entitled to refuse orders without giving reasons. The client may cancel the order free of charge within 24 hours of order receipt without giving reasons; any payments already made are refunded in full. After this period, cancellation is only possible with our consent if the vehicle has already been bindingly procured or reserved; in that case the costs incurred up to that point must be reimbursed.

4. Availability and Reservation of Performance

Information about vehicle availability and delivery dates is provisional and considered approximate. We accept no liability for unavailable vehicles or delivery delays.

5. Our Obligations / Our Services

We undertake to perform the agreed services with due care and to deploy qualified staff. Via the FlexiMoto.ch platform we sell vehicles in our own name and for our own account – the purchase contract is concluded between the client and Finsler Customs GmbH. If in an individual case we merely broker a third party's vehicle, we state this explicitly in the offer.

6. Duties to Cooperate / Your Obligations

You undertake to provide us in good time, completely and in suitable form with all information required for the proper performance of services. Delays or additional costs due to missing or incorrect documents are at the expense of the client.

7. Changes to Services

Change requests will be considered where possible. Changes to the vehicle purchase price, fees, taxes, transport or import costs by third parties are deemed to be a change in services and will be passed on to the client.

10. Liability

Our liability is limited to damages caused by intent or gross negligence. Liability for slight or moderate negligence is excluded. We are liable for defects in accordance with the law; the limitation period is one year from handover. Apparent defects must be reported in writing within seven days, hidden ones immediately upon discovery. We first repair or supply a replacement; only if that fails can the price be reduced or the contract rescinded. Wear and tear and defects that were known or apparent do not count as defects. Transport is generally at the risk of the client.

11. Remuneration, Payment Terms and Default

Remuneration is based on the order confirmation. Prices are stated in CHF or EUR incl. VAT. Amounts in quotes constitute advance payments. Expenses are passed on at actual cost. For foreign currency expenses, the amounts actually paid and the exchange rate on the value date are decisive. Payment is due within 5 days of acceptance, in any case before performance of the service. In case of payment default, default interest and reminder fees (CHF 25.00 per reminder) apply.

12. Contract Duration and Termination

The contract ends with the performance of the agreed services. In the event of early termination by you, the agreed remuneration remains owed; the free cancellation within 24 hours under section 3 remains reserved. Once the vehicle has been made available, the client is obliged to take immediate delivery.

13. Data Protection

We collect and process personal data exclusively within the framework of the legal provisions. Further information can be found in our Privacy Policy, which is an integral part of these Terms.

14. Severability Clause

Should any provision of these Terms be invalid, this does not affect the validity of the remaining provisions.

15. Governing Law and Jurisdiction

Swiss substantive law applies exclusively. The place of jurisdiction is our registered office, unless mandatory statutory provisions stipulate otherwise.

16. Dealer Listings and Prohibited Content

Dealers create their vehicle listings themselves and are responsible for their content. Prohibited content includes in particular false or misleading statements about price, condition, mileage or equipment, offensive, abusive, discriminatory or unlawful content, content that infringes the rights of third parties, and any attempt to deceive. We do not tolerate such content. Every listing can be reported using the «Report listing» button; we review each report within 24 hours and remove the listing where our rules have been broken. In the event of repeated or serious breaches we suspend the dealer account concerned. Users can also hide listings from individual sellers at any time.
